King County offers Wi-Fi Internet connectivity service ("service") to patrons at no cost provided that all patrons are of legal age and have read and agreed to these Terms and Conditions. King County reserves the right to change or terminate the service or change these Terms of Use at any time. King County will give patrons an IP address each time the patron accesses the WiFi and it may change. KING COUNTY OFFERS INTERNET ACCESS "AS IS" AND MAKES NO WARRANTIES OR GUARANTEES OF ANY KIND, EITHER EXPRESS OR IMPLIED. BY CONNECTING TO THE INTERNET VIA THE KING COUNTY NETWORK, THE PATRON ACKNOWLEDGES AND ASSUMES SOLE RESPONSIBILITY FOR THE RISKS ASSOCIATED WITH PUBLIC ACCESS TO THE INTERNET, AND HEREBY RELEASES AND INDEMNIFIES KING COUNTY AND ANY OF ITS OFFICIALS, AGENTS AND EMPLOYEES FROM ANY CLAIM AND ANY AND ALL ACTUAL, SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OR LOST PROFITS THAT MIGHT OCCUR (WHETHER FORESEEABLE OR NOT) ARISING OUT OF THE PATRON’S USE OF THE INTERNET VIA THE KING COUNTY NETWORK. IN NO EVENT WILL THE AGGREGATE LIABILITY THAT KING COUNTY AND ANY OF ITS OFFICIALS, AGENTS AND EMPLOYEES EXCEED ONE U.S. DOLLAR ($1.00). The Internet is a public communications network that contains a large amount of content. King County is not responsible for the accuracy, timeliness, quality, nature, character, or privacy of content that is accessed or transmitted by patrons using the Internet via the King County network. King County prohibits the use of the Internet via the King County network to engage in illegal, improper, actionable or criminal activity; to violate any local, state, or federal statute; to seek access into unauthorized areas or use access codes and/or network identification assigned to others; to access, transmit, upload, or download pornographic, obscene, or sexually explicit material; to threaten, libel and harass others; to violate the copyrights or other intellectual property rights of others; to tamper with King County's network security; to impede, disrupt, or engage in unauthorized monitoring of the Internet use of others; to violate software license agreements; and/or to engage in the unauthorized disclosure, use, and dissemination of personal identification information regarding minors. Examples of improper activities include, without limitation: - Modifying, adapting, translating, or reverse engineering any portion of the King County WiFi - Attempting to break security, access, tamper with or use any unauthorized areas of the King County WiFi - Attempting to collect or maintain any information about other users of the King County WiFi (including usernames and/or email addresses) or other third parties for unauthorized purposes - Creating or transmitting unwanted electronic communications such as "spam," or bulk commercial messages to other users or otherwise interfering with other user's enjoyment of the service - Engaging in any activity that infringes or misappropriates the intellectual property, publicity, privacy or other proprietary rights of others, including patents, copyrights, trademarks, service marks, trade secrets, or any other proprietary right of any third party, or that is defamatory, objectionable, unlawful or promotes or encourages illegal activity - The transfer of technology, software, or other materials in violation of applicable export laws and regulations, including but not limited to the U.S. Export Administration Regulations and Executive Orders - Distribution of any Internet viruses, worms, pinging, flooding, mail bombing, denial of service attacks, defects, Trojan horses or other items of a destructive nature - Accessing illegally or without authorization computers, accounts, equipment or networks belonging to another party, or attempting to penetrate security measures of another system. This includes any activity that may be used as a precursor to an attempted system penetration, including but not limited to port scans, stealth scans or other information gathering activity; or - Using King County WiFi for any unlawful, harassing, abusive, criminal or fraudulent purpose. We have the right to monitor, intercept and disclose any transmissions over or using our facilities, and to provide user information, or use records, and other related information under certain circumstances (for example, in response to lawful process, orders, subpoenas, or warrants, or to protect our rights, users or property) King County is not responsible for providing security measures for patron software or hardware or use of the Internet. The patron is solely responsible for providing all appropriate antivirus and firewall software, and other desired or necessary protections for their devices. King County will monitor sites accessed by patrons of the service. If illicit or unauthorized Internet sites are accessed by a patron, King County may block service temporarily or permanently to that patron. Parents and guardians are expected to monitor their children’s use of the Internet. King County is not responsible for any personal property used to access the Internet via the King County network. King County staff is not permitted to support patron connectivity or computer issues of any type, cannot provide any technical assistance, and can only verify the current operational state of the Internet service. King County does not guarantee availability or access to the Internet or minimum Internet connection speeds on the King County network. The service may not be uninterrupted or error-free. King County does not guarantee the security of the service and that unauthorized third parties may access your computer or files or otherwise monitor your connection. King County is not responsible for loss of data due to service delays or interruptions. Agreement to these Terms and Conditions is required to use this service.
